If Kmart has not developed and commissioned the development of this product or a component of this product then this product or component of this product (as applicable) will remain the intellectual property of the supplier.

If such is the case, the data gathered for this specification will be used for the purpose of validating contents and to demonstrate compliance with the applicable mandatory standards and regulations, and to assist with

managing customer & regulator contacts. Data will otherwise be treated confidentially.

As outlined in the terms and conditions of purchase or supply entered into by the Supplier and Kmart, the supplier assigns all other intellectual property to Kmart unless otherwise agreed by both parties.
