THE SOF T W ARE LICENSE AGREEMENT IS A LEGAL
AGREEMENT
(“AGREEMENT”) BETWEEN YOU (“YOU”) AND ORB NETWORKS, INC.
(ORB). THE PRODUCT WARRANTY STATEMENT IS A LEGAL
AGREEMENT
(“AGREEMENT”) BETWEEN YOU (“YOU”) AND LEGRAND N.A.
(“LEGRAND”)
GOVERN
ING USE OF THE ACCOMPANYING LEGRAND PRODUCT (“LEGRAND PRODUCT”), THE
SOFTWARE
INSTALLED ON THE
LEGRAND PRODUCT (“SOFTWARE”) AND RELATED DOCUMENTATION.
BY
POWERING UP YOUR LEGRAND PRODUCT FOR THE VERY FIRST
TIME OR BY OTHERWISE
USING
THE LEGRAND PRODUCT, OR BY KEEPING (AND NOT RETURNING) THE LEGRAND PRODUCT
PA ST
THE
THIRTY (30) DAYS AFTER THE ORIGINAL PURCHASE DATE, YOU ARE INDICATING
THAT
YOU HAVE READ AND UNDERSTOOD, AND AGREE TO
BE BOUND BY, THE TERMS OF
THIS
AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS
AGREE
MENT, YOU
ARE NOT GRANTED ANY RIGHTS WHATSOEVER IN THE SOFTWARE
CONTAINED
WITHIN THE LEGRAND PRODUCT

IF YOU ARE NOT WILLING
TO BE BOUND BY THE TERMS AND CONDITIONS, YOU SHOULD NOT USE THE LEGRAND PRODUCT
AND
SHOULD IMMEDIATELY RETURN IT TO
THE PLACE OF PURCHASE FOR A FULL REFUND.
Software License (Orb)
Subject to the terms of this Agreement, Orb grants you a nonexclusive, nontransferable license to
run
the Software only on and as incorporated in the Legrand Product. This is a license and not a
sale. You
shall
not (i) copy or distribute, sublicense, lease, rent or otherwise transf er the Software to any third
party
except with and incorporated in the Legrand Product, and then not f or value;
(ii) modify, adapt, alter,
trans-
late, or create derivate works of the Software except to the extent Orb may, in certain jurisdictions,
be
required by law to permit reverse engineering and provided
that the provisions of such law may
not
be waived or conditioned on prior request for information regarding interoperability; (iii)
decompile,
disassemble, reverse engineer or otherwise
derive source code, or attempt to derive source
code,
from the Software; or (iv) have any of the foregoing done for you by a third party. The Software and
all
intellectual property rights therein,
are the exclusive property of Orb or its suppliers. All rights in and
to
the Software not expressly granted to you in this Agreement are reserved by
Orb.
Separately Licensed
Code (Orb)
Certain components of the software included with the Legrand Product are subject to separate
license
terms, including “free” or “open source” license and is not subject to the License above
or the
Limited
Warranty below. As required by the terms of the relevant Separately Licensed Code licenses,
Orb
makes the “free” and “open source” code provided under such licenses,
and Orb’s modifications
to
such code, available on Orb’s website, at no charge. Please visit http://www.orb.com f or detailed
in
formation on our use of third party
software.
Privacy (Orb)
Orb’s privacy policy explains Orb’s privacy policies regarding the collection, use, and disclosure
of
personally identifiable and anonymous information. Such policy may be accessed through Orb’s
web-
site at
http://www.orb.com/privacy
and may be modified by Orb at any time for any reason. Orb
col-
lects and uses anonymous inf ormation that is not personally identifiable to you. Once
you register
the
Legrand Product, we will also collect and use the personally identifiable information that you provide
as
part of registration such as name, address, email address, and phone
information. In connection
with
this Agreement, we may collect and use certain anonymous and personally identifiable
information,
as applicable, regarding the Legrand Product including, but
not limited to, billing records, maintenance
and
repair records, marketing information, and customer feedback. By accepting the terms of this
License
Agreement, you are also accepting the terms
of Orb’s Privacy
Policy.
Advertising and Promotional
Messages (Orb)
Orb and its Service Providers reserve the rights to deliver and display advertising and
promotional
messages to you through the Legrand Product and to include such advertising and
promotional
messages
in or with any user interface, notices or content that is displayed using the Legrand Product
.
Limited P r o d u c t
Warranty (Legrand)
Subject to the provisions herein, Legrand warrants the Legrand Product against defects in materials and
work
manship under normal use for a period of one (1) year from the date of purchase
(“Warranty
Period”).
If Legrand determines that the Legrand Product is defective, Legrand will either repair or replace the unit (with
either
a new or rebuilt Legrand Product, at its discretion) at no
charge. If the Warranty Period has expired,
you
are responsible for the payment of all labor charges and may obtain parts from an Legrand authorized
ser
vice facility or from Legrand directly at
your expense. The foregoing sets
forth
Lerand’s sole obligation and your exclusive remedy in the event of any breach of this limited
warranty.
Warranty Service
Process (Legrand)
The limited warranties set forth above extend only to the original purchaser, provided that: (i) You
have
notified Legrand of such non-conformance of the equipment during the applicable limited
warrant
y
period;
and (ii) Legrand has confirmed such equipment to be non-conf orming. As your sole and exclusive
remedy
and Legrand’s entire liability under this limited warranty, Legrand will,
at its option, repair or replace the
non-
conf orming equipment free of
charge.
To obtain warranty service, you must first obtain an Return Merchandise Authorization (RMA)
number
from a Technical Support Representative at Legrand. A Technical Support Representative may
be
reached
by emailing support at technical.support-hs@legrand.us. Once an RMA number is obtained, your Legrand Product must be
shipped
freight prepaid; in either its original packaging or
packaging affording an equal degree of
prot ection,
to the Legrand authorized distribution facility. If Legrand determines that the returned unit is defective,
Legrand
will either repair the
unit or will supply, at no charge and within a reasonable period of time, a new
or
rebuilt Legrand Product in exchange for the defective unit. In addition, all accessories must be
returned
with
the defective Legrand Product. A new or factory refurbished set of accessories will be furnished
with
the replacement Legrand Product. Failure to return any of the accessory items could
result in a delay
in
receiving the replacement Legrand Product, and/or result in an invoice for the missing
accessories.
In performing warranty service, Legrand may furnish replacement parts on an exchange basis and
re
placed parts will become the property of Legrand. Replacement parts provided by
Legrand shall be new
or
refurbished and of comparable quality, and may be a different part that contains compatible
features
and functions. You will reimburse Legrand for the inspection,
testing and repair of returned
equipment
determined by Legrand not to be defective or which falls under one of the warranty exclusions
described
below. In all cases, Legrand’s determination as
to whether or not the equipment is defective and
covered
by warranty will be final. Any replacement equipment will be warranted hereunder for a period of
one
(1) year from shipment. Legrand
reserves the right to charge additional fees for repairs or
replacements
performed outside of the applicable limited warranty
period
Important:
When emailing for an RMA number, please provide the following information with your
re-
quest: (a) model number, (b) serial number, (c) problem description, (d) software version
(accessible
through the Orb Control Panel on the Personal Computer, (e) date of purchase, (f) place of
purchase,
(g) return shipping address (P.O. boxes are not accepted), and (h) proof of
purchase. Note: Proof
of
purchase will need to be included in the return shipment in order to ensure warranty coverage.
In
addition, Legrand may attempt to troubleshoot the problem prior to
issuing an RMA number. Please
be
prepared to provided additional inf ormation upon
request.
Scope Of and Limitation of
Warranty
The warranty on this Legrand Product is limited to the repair or replacement of defective units as
described
above. This warranty does not cover customer training and education, installation, set up
adjustment
or signal reception problems. This warranty does not cover damage due to acts of God, accident,
mis
use, abuse, negligence, commercial use or modification of, or to any part of, your
Legrand Product.
This
warranty does not cover damage due to improper operation or maintenance, connections to
improper
voltage supply or attempted repair by anyone other than a f acility
authorized by Legrand to service
your
Legrand Product. This warranty is only valid in the country of purchase from an authorized Legrand
distributor
or dealer. This warranty is invalid if the
factory-applied serial number and/or “Warranty Void if
Re
moved” sticker has been altered or removed from the Legrand Product
.
Warranty
Disclaimer
THE LIMITED WARRANTY AND REMEDIES STATED ABOVE ARE EXCLUSIVE AND IN LIEU
OF
ALL OTHERS, ORAL OR WRITTEN, EXPRESS, IMPLIED OR STATUTORY. ANY AND ALL
OTH-
ER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
FOR
A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT OF THIRD PARTY RIGHTS,
QUIET
ENJOYMENT AND ACCURACY ARE EXPRESSLY EXCLUDED. LEGRAND’S WARRANTY DOES
NOT
APPLY TO ANY SEPARATELY LICENSED CODE. THESE WARRANTIES ONL Y
APPLY TO
LEGRAND PRODUCT
S PURCHASED FROM AN AUTHORIZED LEGRAND DEALER. Some jurisdictions do not
allow
limitations on how long an implied warranty lasts. so these
limitations in the software and
hardware
warranties above may not apply to you. These limited warranties give you specific legal rights,
and
you may also have other rights which vary from
jurisdiction to
jurisdiction.
Limitation of
Liability
IN NO EVENT SHALL LEGRAND HAVE ANY LIABILITY TO YOU OR ANY OTHER THIRD PARTY
FOR
ANY LOST PROFITS, LOST DATA, LOSS OF USE OR COSTS OF PROCUREMENT
OF
SUBSTI-
TUTE GOODS OR SERVICES, OR FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL
DAM
AGES ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY
TO USE THE
EQUIP-
MENT EVEN IF LEGRAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN
NO
EVENT SHALL LEGRAND’S TOTAL LIABILITY TO YOU,
WHETHER IN CONTRACT, TORT
(INCLUD-
ING NEGLIGENCE), PRODUCT LIABILITY OR OTHERW ISE, EXCEED THE PRICE PAID BY
YOU
TO PURCHASE THE EQUIPMENT. THE
FOREGOING LIMITATIONS SHALL APPLY EVEN IF
THE
ABOVE-STATED W A R R A N T Y FAILS OF ITS ESSENTIAL PURPOSE. BECAUSE SOME
STATES
OR JURISDICTIONS D O NOT
ALLOW LIMITATION OR EXCLUSION OF CONSEQUENTIAL
OR
INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. Some
jurisdictions
do not allow the exclusion
of implied warranties or limitation of liability for certain incidental or
conse
quential damages, so the exclusions set forth may not apply to
you.
Compliance With
Law
You acknowledge and agree that the equipment is subject to United States export control laws,
includ
ing the United States Export Administration Act and its associated regulations, and may be subject
to
export or import regulations in other countries. You agree to comply strictly with all such
regulations
and acknowledge that You have the responsibility to obtain licenses to export, re-export or
import
the equipment.
Safety and Handling Information
Read and follow this important Safety and Regulatory Compliance Information Statement accompanyingyournewLegrandProduct.Heedallwarningsandkeepthesesafetyandhandlinginstructionsforfutureuse.
ImportantSafetyInformationFailure to observe all instructions contained within this Safety and Handling Information Guide will void the Limited Warranty.
WARNING: FAILURE TO FOLLOW THESE SAFETY INSTRUCTIONS COULD RESULT IN FIRE, ELECTRIC SHOCK, OR OTHER INJURY OR DAMAGE.
DonotoperateyourLegrandProductnearwater.DonotusetheLegrandProduct or Power Supply nearwateror wetlocations (for example,near asinkor bathtub,a wetbasement,orswimming pool), or areas exposed to
the elements. Take care not to spill any food or liquid onto the Legrand Product or Power Supply and Electrical Plug. Should either the Legrand Product or Power Supply become wet, unplug all cables before
cleaning, and allow both the Legrand Product and Power Supply to dry thoroughly before using again.
Do not place naked flame or other significant heat sources on or near your Legrand Product. Keep your Legrand Product within acceptable temperature ranges. Situate and operate your Legrand
Product away from heat sources, such as lighted candles, radiators, stoves, or other apparatus that produce heat. Do not leave your Legrand Product in your vehicle, as temperatures in parked vehicles can
exceed acceptable ranges.
Only use the Power Supply included in the package with your Legrand Product. Do n ot use th e Power Supply to power an y devic e other than your Legrand Product.
Do not overload your power supplies. Do not overload power outlets, extension cords, or convenience receptacles as this might result in a risk of fire or electric shock. Never use a multi-plug adapter to plug
multiple power plugs in the same outlet. To reduce the risk of dam- age to the USB Power Adapter, pull the plug rather than the power adapter cord when you disconnect the USB Power Adapter from the
power outlet or convenience receptacle.
Refer all servicing to qualified service personnel. Never attempt to disassemble or repair your Legrand Product or any components yourself. The Legrand Product does not contain any user serviceable
parts. For service information, please refer to the Warranty Information that was included with your Legrand Product.
Important Handling Information Failure to observe all instructions contained within this Safety and Handling Information Guide will void the Limited Warranty.
NOTICE: FAILURE TO FOLLOW THESE HANDLING INSTRUCTIONS COULD RESULT IN DAMAGE TO YOUR LEGRAND PRODUCT OR OTHER PROPERTY.
Handle your Legrand Product with care. Do not bend, drop, crush, puncture, incinerate, or open your Legrand Product. Do not place heavy objects on the Legrand Product.
Ensure your use correct and proper connectors and ports. Never force a connector into a port. Check for obstructions on the port. If the connector and port don’t join with reasonable ease, they probably
don’t match. Make sure that the connector matches the port and that you have positioned the connector correctly in relation to the port.
Clean your Legrand Product with the necessary care. Unplug all cables before attempting to clean your Legrand Product. Clean only with a soft dry cloth. Avoid getting moisture in openings. Do NOT use
window cleaners, household clean ers, aerosol sprays, solvents, alcohol, ammonia, or abrasives to clean your Legrand Product.

Your Legrand Product generates us es and can radiate radio-frequency energy. If it is not installed and operated correctly in strict accordance with Legrand’s instructions, it may cause interference with radio and
television reception. This equipment has been tested and found to comply with the limits for a Class B digital de- vice, pursuant to Part 15 of the FCC Rules. These limits are designed to provide reasonable
protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the manufacturer ’s
instructions, may cause interference harmful to radio c ommunications. There is no guarantee, however, that interference will not occur in a particular installation. If this equipment does cause harmful
interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures:
• Reorient or relocate the receiving antenna.
• Increase the separation between the equipment and receiver.
Connect the equipment to an outlet on a circuit different from that to which the receiver is connected.
• Consult the dealer or an experienced radio or TV technician for help.
