1. General Information
About this guide
This document provides information on the features,
installation and typical usage of the Solo remote
monitoring and control platform. The information
contained in the appendices can be used as a pocket
reference during installation, commissioning and
troubleshooting.Morespecicinformationonassociated
third-party devices and Observant GlobalTM data delivery
services can be found in the relevant product guides and
via the Observant website.

Legal (Australia and NZ only)
1. ThisLimitedHardwareWarrantyappliestoofcialObservant
HardwareidentiedbytheObservanttrademarkandpurchased
from Observant.
2. Observant will (at its option) repair or replace Observant Hardware
which fails to operate according to all material functionality
described as applying to that Observant Hardware on the
Observant Website due to normal wear and tear at any time
duringtherst:
a. 12 months; or
b. such other period stated on the Observant Website for the
relevant Observant Hardware, from the estimated date on
which the Observant Hardware is ready to be dispatched
from the Observant premises. You are responsible for the
cost and risk of transport of the Observant Hardware to and
from the Observant premises as required by Observant to
evaluate and process any warranty claim.
3. In order to obtain the above warranty service you will be asked to
provide:
a. your name, address and telephone number;
b. proof of the original purchase (receipt) containing a
description of the Observant Hardware, purchase date; and
c. the Observant Hardware serial number.
4. To the extent permitted by law and in addition to and without
limiting the above, the following is not covered by this warranty:
a. Observant Hardware for which you cannot provide the

above information.
b. ObservantHardwarewhichhasbeendamaged,modied
orrecongured(includingsoftware)byapersonotherthan
Observant.
c. Observant Hardware where the case has been opened by a
person other than Observant.
d. Observant Hardware which has been connected to (or
attemptedtobeconnectedto)anyequipmentnotcertied
by Observant as operating correctly with Observant
Hardware.
5. ALL TERMS AND WARRANTIES WHICH MIGHT OTHERWISE
BE IMPLIED BY ANY LEGISLATION, THE COMMON LAW,
EQUITY, TRADE, CUSTOM OR USAGE OR OTHERWISE INTO
THE AGREEMENT, ARE EXPRESSLY EXCLUDED TO THE
MAXIMUM EXTENT PERMITTED BY LAW. WHERE LEGISLATION
IMPLIES INTO THE AGREEMENT ANY TERM OR WARRANTY
THAT CANNOT LAWFULLY BE EXCLUDED, THAT TERM OR
WARRANTY IS INCLUDED BUT OBSERVANT’S LIABILITY IN
RESPECT OF A BREACH OF THAT TERM OR WARRANTY IS, AT
OBSERVANT’S OPTION, LIMITED TO ANY ONE OR MORE OF
THE FOLLOWING:
A. IF THE BREACH RELATES TO GOODS:
I. THE REPLACEMENT OF THE GOODS OR THE
SUPPLY OF EQUIVALENT GOODS;
II. THE REPAIR OF SUCH GOODS;
III. THE PAYMENT OF THE COST OF REPLACING THE
GOODS OR OF ACQUIRING EQUIVALENT GOODS;
OR

IV. THE PAYMENT OF THE COST OF HAVING THE
GOODS REPAIRED; AND
B. IF THE BREACH RELATES TO SERVICES:
I. THE SUPPLYING OF THE SERVICES AGAIN; OR
II. THE PAYMENT OF THE COST OF HAVING THE
SERVICES SUPPLIED AGAIN.
6. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW
AND SUBJECT TO CLAUSE 5, OBSERVANT IS NOT LIABLE
FOR:
A. ANY LOSS OR DAMAGE OF ANY KIND WHATSOEVER
AND HOWSOEVER ARISING OUT OF OR IN CONNECTION
WITH:
I. THE OBSERVANT HARDWARE OR ANY SOFTWARE
PROVIDED BY OBSERVANT; OR
II. THE SUPPLY OF GOODS AND SERVICES BY
OBSERVANT, WHETHER SUCH LOSS OR DAMAGE
IS DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL,
PUNITIVE OR EXEMPLARY (INCLUDING WITHOUT
LIMITATION, LOSS OR DAMAGE, ANY LOSS OF
PROFIT, LOSS OF REVENUE, LOSS OF BUSINESS
OPPORTUNITIES, LOSS OF OR DAMAGE TO
DATA OR LOSS OF GOODWILL, DAMAGE TO OR
REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY
COSTS OF RECOVERING, REPROGRAMMING OR
REPRODUCING ANY PROGRAM OR DATA STORED IN
OR USED WITH ANY OBSERVANT HARDWARE) AND
WHETHER OR NOT THE LOSS OR DAMAGE MAY
REASONABLY BE SUPPOSED TO HAVE BEEN IN THE

CONTEMPLATION OF THE PARTIES AS A PROBABLE
RESULT OF ANY ACT OR OMISSION AND EVEN IF
DUE TO THE NEGLIGENCE OF OBSERVANT OR ANY
OF ITS EMPLOYEES OR AGENTS; AND
B. ANY LOSS OR DAMAGE ARISING WHICH IS NOT
EXCLUDED UNDER CLAUSE 6(A), TO THE EXTENT SUCH
LOSS OR DAMAGE IS CAUSED OR CONTRIBUTED TO
BY YOUR NEGLIGENCE OR OTHER WRONGFUL OR
UNLAWFUL ACTS OR OMISSIONS.
7. The limitations and exclusions in clause 6 apply to any, loss,
damage or claim whether based in contract (including under
any indemnity or for breach of any warranty), tort (including
negligence), under statute or any other legal basis.
8. If you suffer any loss or damage in connection with Observant
Hardware, software or any services provided by Observant, you
must promptly notify Observant, together with details of the loss
or damage suffered, and you must use your best endeavours to
mitigate such loss or damage as far as reasonably possible.
9. No Observant reseller, agent or employee is authorised to make
anymodication,extensionoradditiontothiswarranty.
OTHER TERMS
10. This document contains the entire understanding of the parties as
to its subject matter. There is no other understanding agreement,
warranty or representation whether express or implied in any way

deningorextendingorotherwiserelatingtotheseprovisionsor
binding on the parties with respect to the goods of their operation.
11. The application of the United Nations Convention on Contracts
for the International Sale of Goods (known as the Vienna Sales
Convention 1980) is excluded.
12. If any provision of these terms or conditions is unenforceable,
illegal or void, that provision is severed and the other provisions
remain in force.
13. Observant may amend or vary these Terms and Conditions by
notifying the Buyer in writing of the amendment or variation.
